These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Fit Labs OÜ ("Company", "we", "us", "our"), a company registered in Estonia, governing your use of the maxfit.ee website ("Website") and the purchase of products.

By accessing or using our Website, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Website.

You must be at least 16 years old to use our Website and make purchases. By using our Website, you represent and warrant that you are at least 16 years of age.

4.1 Account Creation

You may create an account to make purchases and access additional features. When creating an account, you must provide accurate, complete, and current information. Authentication is performed via Smart-ID (Estonian national electronic identification). Your email address and phone number are collected for order communication and delivery purposes.

4.2 Authentication & Security

Authentication is handled via Smart-ID, which uses your national identity and PIN codes managed by your Smart-ID provider. Optionally, you may set up a passkey for faster login. You agree to:

• Keep your Smart-ID PIN codes secure and not share them with others
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activities under your account

4.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activity.

You may delete your account at any time from your account settings. See our Privacy Policy for information about data retention after account deletion.

5.1 Product Information

We make every effort to display accurate product information, including descriptions, images, prices, and availability. However, we do not warrant that product descriptions or other content is accurate, complete, or error-free.

5.2 Pricing

All prices are displayed in Euros (EUR). Fit Labs OÜ is registered for Value Added Tax (VAT), registration number EE102972984. All prices include 22% VAT.

We reserve the right to change prices at any time. Price changes will not affect orders already placed.

5.3 Product Availability

Product availability is subject to change. If a product becomes unavailable after you place an order, we will notify you and offer a refund or substitute product.

5.4 Dietary Supplements Disclaimer

Sports nutrition products and dietary supplements sold on this Website are not intended to diagnose, treat, cure, or prevent any disease. Consult a healthcare professional before use, especially if you are pregnant, nursing, have a medical condition, or are taking medication.

6.1 Order Process

When you place an order, you make an offer to purchase products. We will send you an order confirmation email, but this does not constitute acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including product availability, errors in pricing, or suspected fraud.

6.2 Payment

We accept the following payment methods:

• Credit/debit cards (Visa, Mastercard)
• Other payment methods as displayed at checkout

Payment is processed securely through Montonio, our third-party payment processor. We do not store your full payment card details.

6.3 Order Acceptance

Your order is accepted when we send you a shipment confirmation email. At that point, a binding contract is formed between you and Fit Labs OÜ.

6.4 Pricing Errors

If we discover a pricing error after you place an order, we will notify you and give you the option to:

• Proceed with the order at the correct price, or
• Cancel the order and receive a full refund

7.1 Delivery Countries

We ship to Estonia and 23 other EU countries (24 EU destinations in total).

7.2 Shipping Costs

Shipping costs are calculated at checkout based on your delivery country and chosen method. Free shipping is offered only on the Estonia parcel-locker option for orders €50 or more; the Estonian courier and all non-Estonian destinations are charged at the rates shown at checkout.

7.3 Delivery Time

Estimated delivery times are provided at checkout. While we strive to meet these estimates, delivery times are not guaranteed and may be affected by factors beyond our control.

7.4 Risk of Loss

Risk of loss and title for products pass to you upon delivery to the carrier. We are not responsible for lost or damaged packages after they have been shipped.

7.5 Damaged or Lost Shipments

If your shipment arrives damaged or is lost in transit, please contact us at support@maxfit.ee within 7 days of the expected delivery date.

In accordance with the EU Consumer Rights Directive (2011/83/EU) and Estonian Consumer Protection Act, you have the right to withdraw from your purchase within 14 calendar days without giving any reason.

8.1 Withdrawal Period

The 14-day withdrawal period begins on the day:

• You (or a third party indicated by you) receive the product, for single-item orders
• You receive the last product, for multiple-item orders delivered separately

8.2 How to Exercise Your Right of Withdrawal

To withdraw from your purchase, you must inform us of your decision by a clear statement. You can:

8.3 Return Shipping

You must return the products to us without undue delay and in any event no later than 14 days from the day you communicated your withdrawal. Returns must be sent to our Estonia address (Harju maakond, Tallinn, Mustamäe linnaosa, Pöörise tn 7-51, 13520, Estonia).

You are responsible for the cost of return shipping unless the product is defective or we made an error. We will cover return shipping costs only for confirmed defective goods.

8.4 Condition of Returned Products

Products must be returned in their original condition, unopened, and unused. We cannot accept returns of:

• Opened or partially consumed products (for health and safety reasons)
• Products with broken seals (e.g., protein powders, supplements)
• Perishable goods past their expiration date

8.5 Refund

We will refund all payments received from you, including standard shipping costs (but not express shipping upgrades), within 14 days of receiving your returned products or proof of return shipment.

Refunds will be made using the same payment method you used for the original transaction, unless you expressly agree otherwise.

8.6 Exceptions to Right of Withdrawal

The right of withdrawal does not apply to:

• Sealed goods supplied for health protection or hygiene purposes where the seal has been broken after delivery — under Article 16(e) of the EU Consumer Rights Directive (2011/83/EU), the right of withdrawal is lost once you unseal a supplement pouch, capsule bottle, protein powder container, or similar hygiene-sealed product. Once opened, such products cannot be resold and are exempt from the right of withdrawal.
• Perishable goods or products with a short shelf life
• Custom-made or personalized products

Practical effect: if you open a protein powder bag, creatine tub, or supplement capsule bottle, you lose the right to return it under the EU withdrawal right. Products must be returned sealed and unused to qualify for a withdrawal refund.

9.1 Legal Guarantee (Estonian Consumer Protection Act)

Products must conform to the contract. If a product is defective or does not match its description, you may:

• Request repair or replacement (your choice)
• Request a price reduction or full refund if repair/replacement is not possible

This legal guarantee is valid for 2 years from the date of delivery for new products.

9.2 Reporting Defects

You must report any defects within a reasonable time after discovery. To report a defect, contact us at support@maxfit.ee with:

• Your order number
• Description of the defect
• Photos of the defective product (if applicable)

9.3 Manufacturer Warranties

Some products may come with manufacturer warranties in addition to the legal guarantee. Manufacturer warranty terms are provided with the product or available upon request.

All products sold on our Website comply with Estonian and EU safety standards. Sports nutrition and dietary supplement products comply with:

• EU Food Supplements Directive (2002/46/EC)

All content on this Website, including but not limited to text, images, logos, product descriptions, and software, is the property of Fit Labs OÜ or its licensors and is protected by Estonian and international copyright, trademark, and other intellectual property laws.

You may not:

• Reproduce, distribute, or display any content from this Website without our written permission
• Use our trademarks or logos without authorization
• Scrape or data mine our Website
• Reverse engineer or decompile any software on our Website

You agree not to use our Website for any unlawful purpose or in any way that could damage, disable, or impair our Website. Prohibited activities include, but are not limited to:

• Attempting to gain unauthorized access to our systems
• Interfering with other users' use of the Website
• Transmitting viruses, malware, or other harmful code

13.2 Maximum Liability

Our maximum liability for any claim arising from your use of our Website or purchase of products shall not exceed the amount you paid for the specific product giving rise to the claim.

13.3 Consumer Rights

Nothing in these Terms shall limit your statutory rights as a consumer under Estonian or EU law, including:

• The right to withdraw from distance contracts (14-day cooling-off period)
• The legal guarantee for defective products (2-year guarantee)
• Rights under consumer protection legislation

13.4 Force Majeure

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or government actions.

14.1 Informal Resolution

If you have a complaint or dispute, please contact us first at support@maxfit.ee. We will make reasonable efforts to resolve the issue amicably.

14.2 Consumer Dispute Resolution

14.3 Arbitration (Optional)

If informal resolution and consumer dispute mechanisms do not resolve the issue, either party may initiate arbitration under the rules of the Estonian Chamber of Commerce and Industry.

14.4 Jurisdiction

If legal proceedings are necessary, Estonian courts shall have exclusive jurisdiction. For consumers residing in the EU, you may also bring proceedings in the courts of your country of residence.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

As a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

We reserve the right to update these Terms at any time. When we make material changes, we will:

Your continued use of our Website after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using our Website.

For orders placed before a Terms update, the previous version of the Terms will continue to apply to those orders.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fit Labs OÜ regarding your use of our Website and purchase of products.

These Terms supersede any prior agreements or understandings, whether written or oral.

Gift cards purchased on maxfit.ee ("Gift Cards") are subject to the following additional terms:

• Validity: A Gift Card is valid for 24 months from the date it is activated (i.e. from successful payment), not from the date the purchase order was created.
• No cash redemption: Gift Cards cannot be exchanged for cash, in whole or in part, except where required by law.
• Non-refundable: Gift Card purchases are final and non-refundable for cash. Any unused balance remains redeemable for products until the card expires.
• One card per order: Only one Gift Card may be applied per order.
• Cannot be used to buy another Gift Card: A Gift Card balance cannot be used to purchase additional Gift Cards.
